A study of insolvency law in central european  transition economies with particular reference to the banking sector

"The main lesson and recommendation emerging from my work is the necessity for the adoption of bankruptcy rules and proceedings specialized for and adapted to banks and their key role in every Post Socialist's Economy.

The bankruptcy law must provide for preventive prudential measures and an effective early-warning system, but when bankruptcy occurs, the law must allow for quick and effective exit in order to limit the damages for the failed bank and the entire banking system and economy.

While comprehensive, I argue that bank bankruptcy law should be intelligible and visible to the wider populance.

Critical to the development of an effective bankruptcy law across the broader spectrum and particularly with regard to bank distress, there is the need for a specialized bankruptcy court dealing with bankruptcy cases.

There is the need for an independent court system and judiciary."
